The Continuing Car Retirement Communities Act requires licensing of communities that contract for board or lodging together with nursing, medical or other health related services to persons 65or older, or which require an entrance fee or provide services for over one year.
Nursing homes at all levels of care are strictly regulated and inspected by the state. The Long term Care Ombudsman program (Division of Aging, Office of the Governor) investigates complaints about health care facilities. The Omnibus Adult Protection Act of 1993 gives rights and protection against adult abuse, neglect and exploitation.
The Joint Legislative Committee on Aging three House and three Senate members and three gubernatorial appointees looks out for the concerns of our "Over 50s" citizens. For example they helped to enact the homestead tax exemption. The first $20,000 in fair market value of a home of those 65 and up, who have lived in South Carolina at least one year, (including manufactured homes on leased land) is exempt from municipal, county, school and special assessment real property taxes. This also applies to property held in a revocable trust. This exemption is also extended to a surviving spouse 50 or older and may be transferred to a new dwelling. There is a $3,000 Retirement Income Exclusion on the South Carolina state income tax for pensions and distributions from IRAs, SEPs and KEOGHs for persons 65 and over. A $10,000homestead exemption is granted to homeowners over the age of 65.
